By accessing or using The Owner Of (theownerof.com) and our companion mobile applications, you agree to be bound by these Terms of Service. If you do not accept these terms in full, you must discontinue use of the platform immediately.

3. User-Generated Content & Full User Liability

The Owner Of functions as an open, neutral public directory and community leaderboard. All business listings, company profiles, website URLs, descriptions, contact details, logos, and associated multimedia are User-Generated Content (UGC) submitted directly by independent third-party users:

• Sole User Responsibility: The individual or entity submitting a listing is 100% solely and exclusively responsible and legally liable for all content, claims, trademarks, and links provided. The Owner Of does not pre-screen, investigate, endorse, or verify the legitimacy or ownership of user-submitted materials.
• Warranty of Rights: By submitting a listing, you warrant and represent that you possess all necessary intellectual property rights, licenses, or legal authorizations to list the specified business, brand, domain name, and trademark.
• Hosting Provider / Intermediary Safe Harbor: The Owner Of and its operator (42code.net) act solely as a technical intermediary and hosting service provider (under DMCA, Section 230, and equivalent international intermediary liability safe harbors). We bear zero liability for unauthorized listings, defamatory remarks, trademark disputes, or deceptive content uploaded by users.
• User Indemnification: You agree to defend, indemnify, and hold completely harmless The Owner Of, 42code.net, its founders, and technical operators from and against any lawsuits, third-party claims, liabilities, damages, fines, or legal expenses arising out of or related to your submitted listings or breach of these terms.

4. Community Voting & Fair Play Rules

• Voting Limits: Upvoting is capped to encourage genuine community discovery. A user may cast up to 1 upvote per owned territory across the map. Free ad-rewarded votes are limited to 3 accumulated claims with a mandatory 6-hour cooldown.
• Bot & Exploit Prevention: Any artificial manipulation, exploitation of software bugs to generate unauthorized upvotes, or automated bot scripts will result in immediate voiding of votes and account termination.

5. Prohibited Content & Immediate Termination

The following activities are grounds for immediate delisting, vote forfeiture, and permanent account suspension:

• Malware, phishing, spyware, crypto scams, or deceptive affiliate schemes.
• Defamatory, fraudulent, hate speech, violent, or sexually explicit content.
• Infringing on registered trademarks, patents, or copyrights without legal authorization.
• Automated scraping, denial-of-service attempts, or security vulnerability probing.

If you are a legitimate trademark holder, business owner, or authorized representative and believe that a listing on The Owner Of infringes upon your intellectual property or represents your company without permission, we provide an expedited Notice & Takedown process:

The Owner Of is provided "as is" and "as available" without warranties of any kind, express or implied. Under no legal theory (contract, tort, negligence, or otherwise) shall The Owner Of, 42code.net, or its affiliates be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of your use of or inability to use the platform.
